澳大利亚移民部2014年五大政策改变！

自从自由联盟党上台以来，大家就寄于了很高期望，千等万等，终于有好消息了，自2014年3月22日起，澳大利亚移民部出台一些新政策了！

第一个变化： 澳洲留学签证降低要求，初中留学对华首次放开，高二毕业就可以读TAFE。

澳洲移民部DIBP将开始大幅调整对海外学生设立的风险等级架构。现有四级风险都将降为三级，而原有五级风险简化为三级（即一级为低风险，二级为中等风险，三级为高风险），具体要求我们举例来分析一下。

先拿571中学签证来说：

-担保要求降低：风险等级架构变更后，担保金要求也从定期存款6个月覆盖24个月学费生活费降低为存款3个月只要覆盖12个月的担保金。

-小学6年级毕业就可申请澳洲的学生签证（571类），入读7年级（初一），而此前需要初中毕业才可申请留学10年级（相当于高一）。但是移民局同时指出孩子如果上9年级必须小于17周岁,8年级必须小于16周岁，7年级必须小于15周岁。

Schedule 5A requirements of AL 3 for subclass 571, an applicant whois proposing to undertake:

• Year 9, should be less than 17 when commencing Year 9

• Year 10, should be less than 18 when commencing Year 10

• Year 11, should be less than 19 when commencing Year 11 and

• Year 12, should be less than 20 when commencing Year 12.

For studies at the Year 8 level or below:

• AL 3 Schools Sector applicants must provide evidence (under571.231), that they are of an appropriate age for their entry levelto their principal course. This is to ensure students at the year 8level or lower will meet the age requirements above if theyprogress to years 9-12 - see section 89 Schools Sector - Schedule 2requirements

• AL 4 and 5 applicants must not undertake studies at the year 8level or lower unless they are a secondary exchange student (as per5A303(2) and 5A306(2)).

再拿572职业教育培训签证来说

- 中学生完成11年级高二即可申请澳洲的技术专修课程（572类），此前需要中学12年级毕业才可申请。

-申请技能专修课程（572类）签证，配语言课程的最低雅思要求下调为均分4.5，而此前要求均分5.0才可以。语言课程的允许长度增加到30周

-资金担保要求只需计算开始12个月的学费和生活费，此前要求计算18个月。担保金需要存款3个月或者是银行留学贷款。

值得提醒大家的是，对于三级风险签证来说，风险等级架构变更前，任何人都可成为三级风险等级申请人的资金担保人。但架构变更后，所有三级风险等级的申请人提供的资金必须出自申请人“本人，或配偶，或父母，或祖父母，或兄弟姐妹，或居住在澳洲，身为澳洲永居或澳洲公民的叔伯姑舅姨”。这个本来是等级四对资金担保人的要求，变更后将适用于所有等级三（高风险国家及地区）的资金担保人。不过黄文勇老师认为这个对于中国留学生家庭应该也不是问题，571和572原来就是四级风险，可以用留学贷款来对付；573的本科硕士签证目前主要走SVP相当于一级风险，签证无需担保金和英文考试成绩！

总体来说，此次调整为申请者带来的更多是正面的积极消息，很多急于把孩子带离雾霾和沉重压力的家长，现在就可以行动啦。

第二个变化：移民局严惩造假者，发现造假10年内不可以进来澳洲。

澳大利亚移民局规定对于申请技术、商业、临居、学生和家庭类签证的申请人，如果发现有材料作假，违反PIC4020条款，那么10年内再申请这些签证都会拒签。因为作假被拒签，是很难得到部长豁免的。

Visas affected by PIC 4020

If you have applied for any of the following visas, you mustsatisfy PIC 4020:

· skilled migration

· business

· temporary visas

· student visas

· family visas.

From 22 March 2014, new provisions will be added to the current PIC4020. As part of this new requirement you must satisfy us of youridentity to be granted a visa.

This requirement is not subject to a waiver. If you are refused avisa because you do not meet PIC 4020 on identity grounds, anothervisa that includes PIC 4020 as part of the critieria will not begranted to you for a period of 10 years after refusal.

This means if we are not satisfied of your identity:

· your visa might be refused; and

· if it is refused on that basis, you cannot be granted anothervisa (where that visa includes PIC 4020 as part of the criteria)for 10 years.

From 22/03/2014 the Migration Regulations were amended by Schedule1 of SLI 2014:

•to introduce a new requirement into Public Interest Criteria (PIC)4020 - clause 4020(2A) - for any visa which requires the applicantto meet PIC 4020, the applicant is required to satisfy the Ministeras to their identity

•to introduce a new requirement into PIC 4020 - clause 4020(2B) -for any visa which requires the applicant to meet PIC 4020, theMinister must be satisfied that the applicant or a member of thefamily unit of the applicant has not been refused a visa in the 10year period before the time of application due to failing tosatisfy the Minister as to their identity.

The 10 year period applies to refusals made under the new identityrequirements, not to refusals made under clauses 4020 (1) and(2).The 10 year period operates concurrently, not cumulatively,with a second 10 period under clause 4020(2B), or with the 3 yeartime period under clause 4020(2).

Unlike the Minister’s ability to waive the requirements of clauses4020(1) and (2), the Minister does not have the ability to waivethe new identity related requirements.The purpose of this amendmentis to strengthen the integrity of the migration program and todeter identity fraud by introducing strict consequences where avisa is refused because the applicant, or a member of their familyunit, failed to satisfy the Minister as to their identity.

第三个变化： 移民局增加信用卡手续费收费

目前澳洲签证主要走电子签证eVisa，信用卡公司要向移民局收手续费，移民局决定把这些费用转嫁给申请人，所以大家递交签证的时候记得多准备一点。移民局这一招够狠，但是我们除了抗议也木有办法。

第四个变化：8202条款签证违规不再被100%驱逐

From 22/03/2014, Schedule 2 of the Migration Regulations wasamended to repeal the visa criterion relating to ‘substantialcompliance’. This criterion was removed to provide decision makerswith the discretion to take into account exceptional circumstancesthat may have led to a Student visa holder unintentionallybreaching a condition of their Student visa. Exceptionalcircumstances may include upheaval in the student’s home country,illness or bereavement.

第五个变化：143父母付费移民费用增加

From 22/03/2014, the Migration Regulations were amended to increasethe visa application charge for Contributory Parent (Migrant)(Class CA) visa and Contributory Aged Parent (Residence) (Class DG)visa to the limit prescribed by the Migration (Visa Application)Charge Act 1997. The amendments also correct technical errors inthese provisions.

父母付费移民的好处很多，大概1年半可以拿到PR，不过初期投资也不少，4月后是43800澳元。
